This "Privacy Policy" communicates the processing of your personal data by the following processing manager: Sharp & Wolf, Zeedijk-Albertstrand 513, 8300 Knokke-Heist and registered in the K.B.O. under number VAT BE 0464 201 220. This privacy policy provides the essential information by which your personal data are processed.

By providing your Personal Data on the website and by providing email addresses listed on this website with Personal Data, you declare that you have read this Privacy Policy and also expressly agree to it, as well as to the processing itself.

Article 1 - General

"Sharp & Wolf" makes every effort to also comply with the European Data Protection Regulation 2016/679 of April 27, 2016 (General Data Protection Regulation or better known as GDPR).

Article 2 - Personal data

2.1. Personal information you provide to us:

• Category 1, no registration required: your IP address
• Category 2: via cookies: tracking website usage
• Category 3: Contact and financial information provided in a contact request or quote request
• Category 4: Information about how you use our emails and the pages linked within them: whether you open an email, which links you click on, and which projects and properties you view or request information about on the pages linked in that email.

2.2. “Sharp & Wolf” may collect information about you (Personal Data) in various ways:

• through the use of cookies
• through the personalized link in our emails: each recipient receives a unique code in the link, which allows us to see what you view on our pages after clicking on the link. We do not place any cookies for this purpose, nor do we store anything on your device.
• when submitting a contact request, using the website, or using a service provided by “Sharp & Wolf”

Article 3 - Purposes of processing

3.1. General Purposes

"Sharp & Wolf" will use the Personal Data collected from you only for the following purposes:

• Category 1: maintaining and improving this website and including Personal Data in anonymous statistics from which the identity of specific individuals or companies cannot be determined, based on the legitimate interests of “Sharp & Wolf” in continuously improving its website and services
• Category 2: Improving the user experience, based on your explicit, prior consent
• Category 3: the provision and billing of services you have requested, based on the legal ground of providing a service you requested
• Category 4: Providing you with targeted and personalized information about the real estate that interests you. We use this data to contact you with the appropriate information when you express interest in a project and to improve our emails. The legal basis is our legitimate interest in providing existing customers and prospective clients on our mailing list with information that aligns with their interests. You may object to this at any time (see Section 6.3), and every email contains an unsubscribe link.

You are not required to disclose your personal data, but understand that providing certain services becomes impossible if processing is refused.

3.2. Direct Marketing

If you are already on our mailing list to receive marketing materials in print and/or electronic form, “Sharp & Wolf” may use your information to send you marketing and other materials related to our various services or to conduct remarketing.

"Sharp & Wolf" will not sell, rent or make your Personal Data commercially available to third parties, except with your prior consent.

3.3. Where We Process Data

1. We and our processors process your personal data within the EEA (European Economic Area) as much as possible. For certain services, this is done (also) outside the EEA. In such cases, this is done only with the appropriate safeguards described below.

If such a transfer takes place, we will ensure that appropriate safeguards are in place to guarantee the security and integrity of your personal data, and that all rights relating to personal data that you may be entitled to under applicable mandatory law are guaranteed.

4.1. In order to process your personal data, we grant access to your personal data to any employees.

Article 5 - Duration of processing

We store and process personal data for as long as necessary to fulfill the purposes of the processing and in accordance with the (possible contractual) relationship between “Sharp & Wolf” and you.

We retain data about your use of our emails and the linked pages (Category 4) for up to 12 months after your last visit. If you object or unsubscribe, we will delete this data sooner.

Article 6 - Your rights

The following rights regarding your personal data may be exercised at any time upon simple request.

6.1. Right of Access and Inspection: You have the right to review your personal data at any time, free of charge.

6.2. Right to Rectification, Erasure, and Restriction: You are free to decide whether or not to provide your personal data to “Sharp & Wolf.” In addition, you always have the right to request that we rectify, supplement, or erase your personal data.

6.3. Right to Object: You always have the right to object to the processing of your personal data for serious and legitimate reasons or for direct marketing purposes. In particular, you may object at any time, free of charge, and without providing a reason, to the tracking of your use of our emails and the linked pages. To do so, send an email to mail@sharpandwolf.be or unsubscribe using the link at the bottom of each email. We will then delete this data.

6.4. Right to Data Portability: You have the right to receive your personal data in a structured format and/or to transfer it to other data controllers.

6.5. Right to Withdraw Consent: If the processing is based on your prior consent, you naturally have the right to withdraw that consent.

6.6. Exercising Your Rights: You can exercise your rights by contacting us, either by email at mail@sharpandwolf.be or by mail at our business address. We may request additional identification to verify your identity.

6.7. Automated Decisions and Profiling: Based on the projects you view through the links in our emails, we track your areas of interest so that a staff member can provide you with tailored information. This is a limited form of profiling. No decisions are made that are based solely on automated processing and that have legal consequences or otherwise significantly affect you.

Article 7 - Security and confidentiality

7.2. Under no circumstances shall “Sharp & Wolf” be held liable for any direct or indirect damages resulting from the incorrect or unlawful use of personal data by a third party.

7.3. You must comply with the security guidelines at all times. You are therefore solely responsible for any use made of your computer, IP address, and identification information through the website, as well as for maintaining their confidentiality.
